Terms and Conditions of Sale for OWN Card

1. Scope of Application and Object

1.1. SIBS Cartões - Produção e Processamento de Cartões, S.A, S.A., a company headquartered at Rua Soeiro Pereira Gomes, Lot 1, 1600-196 Lisbon, registered with the Commercial Registry Office of Lisbon under the unique registration number and tax identification number 506724778, with a share capital of €1,500,000.00 (one million five hundred thousand euros), hereinafter referred to as "SIBS Cartões," provides distance selling of OWN Card equipment (digital business cards), hereinafter referred to as "Products."

1.2. These Terms and Conditions apply to the purchase and sale of the Products through their respective online store by the Buyers.

2. Product Information and Functionality

2.1. The Products allow for altering shared information (name, email address, company, position, phone contact, website) at any time, thanks to its profile management platform, within the terms and conditions defined by that platform and in force at any given time, which must be fully respected by the users.

2.2. The features and other rules for using the Products are available in the instructions sent together with the Products, which must be fully respected by the users.

3. Purchase Conditions

3.1. The indicated price, including VAT at the legal rate in force, will be increased, unless otherwise indicated, by the cost of delivering the Products to the address indicated by the Buyer, according to the applicable tariffs at each moment, in case the address is located in a country other than Portugal.

3.2. Promotions, discounts, sales, or promotional codes are not cumulative unless expressly stated otherwise.

3.3. All aspects related to the Products, including prices, information, specifications, promotional actions, and services, may be changed at any time by SIBS Cartões, provided that this does not have retroactive effects.

3.4. Products purchased through available channels will be delivered as indicated in the following clause.

3.5. The delivery service does not include the setup and activation of the Products. It is the responsibility of the Buyer to install and connect the Products with the respective profile management platform, according to the provided instructions.

4. Shipping and Delivery Service

4.1. SIBS Cartões provides delivery service in Portugal for purchased Products without additional costs, and delivery methods and times can be confirmed in the Buyer's Shopping Cart.

4.2. After purchasing the Products, the Buyer will receive confirmation of the order, and subsequently, the delivery will be scheduled within the expected timeframe at the time of the order.

4.3. SIBS Cartões will make the best efforts to dispatch and deliver the ordered products within the estimated deadlines, which may change according to the time of year and number of orders.

4.4. If delivery is not possible due to inaccuracy or lack of truthfulness of the information provided by the Buyer, or if delivery to the indicated address is not possible for reasons not attributable to the distributor, the Products will be returned, and the order will be canceled.

4.5. In the event outlined in the previous number, the Buyer must contact Customer Support through the indicated contact methods (see clause 11) and request a refund of the amount paid, minus any shipping costs, or alternatively, request the re-sending of a new Product, bearing the applicable shipping costs.

5. Loss, Theft, or Robbery

5.1. In case of loss, theft, or robbery of the Products, the Buyer must immediately contact Customer Support through the indicated contact methods (see clause 11).

5.2. Without prejudice to the above, the Buyer must immediately proceed with the blocking of the Product using the option provided for this purpose on the profile management platform.

6. Order Cancellation

6.1. In case of unavailability of the Products, the order will be automatically canceled, informing the Buyer.

6.2. Without prejudice to the right provided in clause 7, the cancellation of the order by the Buyer does not entitle them to be reimbursed for shipping costs or other delivery charges when the ordered Products have already been dispatched.

7. Legal Warranty

7.1. Without prejudice to the provisions of clause 2.2, Products purchased by a consumer, as an individual not using them for their professional, commercial, or industrial activities, have a legal warranty of 3 (three) years from their delivery.

7.2. The Buyer must keep the invoice, at least during the legal warranty period, and it is essential to present it to benefit from the warranty.

7.3. If the items received by the Buyer show any lack of conformity, the Buyer must contact Customer Support through the indicated contact methods (see clause 11) to exercise their rights to restore the Product's conformity.

7.4. When the malfunction or deterioration of the Products is attributable to the Buyer, especially if it results from disregarding the Product's instructions, the costs associated with replacement or technical repair will be fully borne by the Buyer.

8. Right of Withdrawal

8.1. Under the terms of article 10 of Decree-Law No. 24/2014, of February 14th, the consumer may freely revoke the Contract within 14 (fourteen) days from the delivery of the Products, through an express and unequivocal declaration of revocation of the Contract directed to SIBS Cartões through the indicated contact methods (see clause 11), sending proof of the Product's return and the respective invoice to support@owncard.io.

8.2. The reimbursement of the payment made by the consumer will be carried out after verifying the condition of the Product, using the same payment method used in the purchase, unless otherwise agreed between the parties.

8.3. SIBS Cartões does not cover the costs of returning the Products in case of exercising the right of free resolution by the consumer, which will be calculated according to the shipping location, based on the available tariffs at each moment.

8.4. The consumer cannot exercise the right provided in number 1 if the Products are not in conditions for return due to the Buyer's lack of diligence or if the handling of the Products exceeds what would be permitted in a commercial establishment.

9. Sale of Products

SIBS Cartões reserves the right to suspend or terminate the sale of Products through available channels, as well as to take measures it deems necessary to safeguard its rights in situations of risk of violation of these Terms and Conditions, including blocking the online store, without entitling the Buyer to be indemnified or compensated.

10. Intellectual Property

The online store is a platform registered by SIBS Cartões, and the services provided by it are its responsibility, with the trademarks, logos, slogans, symbols, and information used belonging to SIBS Cartões, another entity of the SIBS Group, or their use being the result of duly granted authorization from the respective owner.

11. Personal Data

The rules applicable to the collection and processing of personal data are regulated in the Personal Data Protection Policy available at https://shop.owncard.io/policies/privacy-policy.

13.Complaints

Without prejudice to the previously indicated contact methods, the Buyer has access to the Electronic Complaints Book (https://www.livroreclamacoes.pt/) to submit complaints, suggestions, or compliments to the economic operator, as well as to request information from supervisory entities (ASAE) or consult submitted complaints, under the terms of Decree-Law No. 156/2005, of September 15th (in its latest version approved by Decree-Law No. 74/2017, of June 21st).

14. Law and Competent Court

14.1. The relationship between the parties resulting from the Contract will be governed, in addition to the provisions contained in these Terms and Conditions, by the Portuguese law in force at each moment.

14.2. In case of a dispute regarding the validity, effectiveness, interpretation, or execution of the Contract, SIBS Cartões and the Buyer agree that it shall be submitted to the exclusive jurisdiction of the Judicial Court of the District of Lisbon, expressly waiving any other, except if a different solution results from a mandatory legal provision, and without prejudice to the right of recourse, under the law, to alternative dispute resolution mechanisms.

15.Alternative Dispute Resolution

In the event of a consumer dispute, defined by law as an individual acting for purposes outside their commercial, industrial, artisanal, or professional activity, they may, under the terms of Law No. 144/2015, of September 8th, resort to available arbitration centers which can be consulted through the Directorate-General for Consumers at https://www.consumidor.gov.pt/.
